3. Minutes Approval: Denis Degher motioned to approve the October minutes; the vote was 7-0 in favor of approval.
4. Treasurer’s Report: Tom Banish reported a treasury balance of $1035.69.
5. Chair’s Report: Denis Degher expressed concern about the Advisory Council not being informed about Paul Viborg’s request for a Conditional Use Permit, Revised Reclamation Plan, and Interim Management Plan to allow for the operation of the existing North River Road Concrete and Asphalt Recycling Operation. The Planning Commission approved Mr. Viborg’s request on November 13, 2008 which included an on-site sorting and stockpiling of sand, gravel, concrete and asphalt, a portable rock and recycling crusher, and trucking scales. Mr. Degher further explained that there was evidently a small sliver of land between Paso Robles and San Miguel that was not considered to be part of the Vicinity of San Miguel. Mr. Degher suggested writing a letter to the Planning Commission and Board of Supervisors suggesting that the Vicinity of San Miguel extend to the Paso Robles City Limit to avoid creating a “no mans land.” Steve McHarris motioned to request that the SMAC boundary be adjusted to the northern boundary of Paso Robles and west of the airport area, and the southern boundary be continuous to the Paso Robles City Limit. Mr. McHarris further motioned to have the revised map brought back to the Advisory Council as an agenda item for clarification. The vote was 7-0 in favor of the letter.
Mission Market and Deli announce that they will be selling distilled spirits in the near future and want to know what the Advisory thinks about it. SMAC unable to vote on issue due to it not being on the agenda.

b. CSD Report: Mike Sanders attended the November 20th CSD meeting and reported the following.
The 14th Street Drainage Project was delayed by fiber optics, train tracks, and the possibility that the County might have to run hoses to private homes for water.
The new water tanks are not being completed according to the engineer’s time line of two years. Fines can be given to contractors if the project is not completed on time.
Mr. Sanders asked the CSD about missed County workshops. The directors stated that they would attend the next one.

d. Community Service Organizations (3-5 min per organization): Jean Hauffmann of the San Miguel Resource Center stated that the San Miguel Library is in need of a new flag pole. The San Miguel Community Support Center (mobile unit at Lillian Larsen) welcomes all San Miguel residents.
8. Public Comments: Colleen Enk followed up further on the Viborg Concrete and Asphalt Recycling Operation on North River Road. Ms. Enk informed us that a permit was not required of Mr. Viborg unless recycling efforts exceeded fifty percent of total mining operations. Gary Davis also commented that Viborg has been operating a concrete and asphalt recycling facility for thirteen years without a permit. Mr. Davis further stated that the facility didn’t meet necessary codes to be a recycling facility. These codes consist of a wall around the facility, landscaping around the wall, recycling slabs to prevent leakage into the ground, and truck traffic. Neighbors have two weeks to appeal the decision by the Planning Commission.

1. Sewage Sludge Land Ordinance-David Broadwater
For over ten years, the CSI, Center for Sludge Information, has participated in the development of SLO County policy regarding sewage sludge land application. In March 2010 the current effective Interim Moratorium Ordinance which maintains sewage sludge land application will expire. On 7/25/08 CSI received a draft permanent ordinance regulating sewage sludge land application in SLO County from the EHD, Environmental Health Division. Included was notice of a comment period closing on 12/01/08 after which a second draft would be circulated. On 8/14/08, the CSI distributed its initial impressions about some of the potentially positive and negative aspects to various parties. It found that the proposed draft failed to conform to Board of Supervisor and SSLATF, SLO Co. Sewage Sludge Land Application Task Force, guidance regarding the formulation and structure of such an ordinance rendering it inadequate and ineffective, and requiring reorganization of its evaluation and significant revision of its content. Over six years ago, The Board of Supervisors directed the EHD to formulate a permanent ordinance in conformity with SSLATF recommendations. The new draft ordinance fails to implement thirteen of the fifteen recommendations. (For more information: csi@thegrid.net)
Steve McHarris requested more time than 12/01/08 to review the draft ordinance and suggested having a complete presentation so that sewer sludge information can reach the public. Rich Lickinfield is the contact person.
