3. Minutes Approval: Denis Degher motioned to approve the November minutes; the vote was 7-
0 in favor of approval.
4. Treasurer’s Report: Tom Banish reported a treasury balance of $1035.69.
5. Chair’s Report: The meeting of the SM Design Plan subcommittee (Denis Degher, Steve McHarris, and Deborah Lewis) has been moved to March. No official date has been set yet. Gary Davis spoke about the 3-2 vote of the Board of Supervisors on December 16th to approve the Viborg Sand and Gravel Mine. Chair, Jim Patterson, expressed the need for an EIR, but Vice Chair, Harry Ovitt, pushed the vote. Lawsuits are expected. Denis Degher sent a letter on behalf of the San Miguel Advisory Council apposing the proposed mine.
6. County Planning Report: Elizabeth Kavanaugh reported that the Planning Commission approved the following Conditional Use Permits: DRC2007-00165 Local Locket Inc. and DRC2007-00158 Marsden. On Thursday, January 22nd the County Planning Commission will hear the Pehl Sand and Gravel Mine proposal. The San Miguel Archangel Church will be having a groundbreaking ceremony for the new community center on December 21st at 12:30 PM .
7. Public Reports:
a. CHP and or Sherriff: No Report
b. CSD Report: (Comments from Betty Cazaly to Denis Degher via email on November 23rd ) Betty Cazaly attended the November 20th CSD meeting and spoke about David Broadwater’s information concerning sewage sludge. Ms. Cazaly asked the CSD what they do with their sludge. Ms. Cazaly was told that the Regional Water Quality Board instructs the CSD on its disposal. Mike Ellison, the CSD Manager, stated that the sludge is tested for mineral content before it is hauled away. The sludge is taken to the Chicago Landfill. The frequency of removal is 5-10 years. Dale Hamblin reported that the San Miguel Ranch EIR would be out in December and that the CSD would be getting a copy of the EIR. They plan to review and move forward.
At the meeting Dale Hamblin from the CSD informed the Advisory Council of their December 18th agenda which included the following: swearing in new four year directors, reviewing legal council contract, and discussing ideas on how to improve attendance at meetings. Dale Hamblin also commented that our sewage sludge is always tested, contains no heavy metals, can be used as a groundcover, and a program has been initiated to move sludge yearly.

9. Community Service Organizations (3-5 min per organization): No Report
10. Public Comments: Colleen Enk spoke further on the Viborg hearing with the Board of Supervisors on December 16th and stated that the applicant came up with his own findings and conclusions and were adopted by the BOS instead of the conclusions of the Planning Department and other official organizations.
11. Old Business: Proposed Cell Tower Site-DRC-2008-00063 PG&E / Metro PCS, North Co E -Ref, CMUP-North River Road Per Elizabeth Kavanaugh, this project proposes to add an additional 8-10 ft. antenna and base panel to an existing cell tower on North River Road. Due to the absence of the designated spoke person for the proposed cell tower additions, Denis Degher motioned to put the project on the February agenda so that technical questions pertaining to the project could get answered.
12. New Business:
1. Delivery of copies of the San Miguel Ranch EIR to SMAC Per Elizabeth Kavanaugh, copies of the San Miguel Ranch EIR were delivered during the December 17th meeting. There will be an EIR discussion at the Lillian Larsen Gymnasium on January 13th from 7-9PM. Steve McMasters, from County Planning, will be in charge of the meeting. 2. SUB 2008-00037-COAL 08 0147 Brodine Applicant withdrew request to turn two smaller lots into larger lots because he would have had to get rid of a garage.
3. DRC 2007-00202 Donelly Windmill Mr. Donelly of Independence Ranch on Sweety Lane wants to erect a 45ft, 1.9 KW continuous Skystream Residential Power Appliance (Windmil) on his property to assist him in “going green.” The price of the windmill as stated by the applicant was $9,500, and the permit was $4,000. The Skystream is advertised as efficiently and quietly providing 40-90% of the energy needs for a home or small business. Any extra energy is fed into the grid spinning the meter backward. The windmill is guaranteed for five years. Comments from the council included concerns about noise, height, noticing neighbors, and disturbance to migratory birds. Steve McMasters from County Planning stated that the county checks into all these issues prior to approval. McMasters further stated that the windmill should be above the height of the trees and that there are setback requirements for neighbors. Elizabeth Kasanaugh from County Planning further commented that the County has an ordinance to protect migratory birds and that new mills are slower thus allowing birds to navigate around them better. Denis Degher motioned to approve the project and Noel Carpenter seconded it. The vote was 6-0 in favor of the project. The motion was to approve the project so as to encourage the county to “go green” and to recommend that the County remove or reduce the $4,000 permit fee so as to encourage others to use wind power.
4. CRP 2007-0001 Horse Allowance Amendment
The County is changing its current horse ordinance from requiring 1acre of land to keep a horse to .9 acre of land. This will allow .1 acre for the street and thus allow more people to keep horses.
The Advisory Council had no concerns pertaining to this amendment and did not feel the need to vote on it.
5. Review Adjusted SMAC Planning Area Map
After last months meeting and the discovery of a “no mans land” next to the Paso Robles City Limit, Mr. Degher requested to Mr. Olivera at County Planning that the “no mans land” be added to the San Miguel Vicinity. Noel Carpenter motioned to approve the adjusted SMAC Planning Area Map and Denis Degher seconded it. The vote was 6-0 in favor of the annexation. The San Miguel vicinity now extends to the Paso Robles City Limit and the “no mans land” no longer exits.
Dale Hamblin from the audience thought it was absurd to go all the way to the Paso Robles City Limits and thought that San Miguel should be concerned with the Salinas River Corridor.
Noel Carpenter commented that the addition gives people in the “no mans land” representation.
