3.   Minutes Approval:  Denis Degher motioned to approve the January minutes with a few minor             corrections which were given to the secretary. The vote was 7-0 in favor of approval with        corrections. Secretary to email council members corrected version of minutes.

4.   Treasurer’s Report:  Tom Banish reported a treasury balance of $1035.69.

5.   Chair’s Report:  Denis Degher attended the CAC County Chair meeting last week. March 12th          the Board of Supervisors will discuss the Housing Element updating sloplanning.org changes.           New E-Comment form will allow people to type in specific comments about individual projects.

6.   County Planning Report: Elizabeth Kavanaugh from County Planning and Building reported that on May 28th the County Planning Commission will have a study session on the proposed San Miguel Ranch Project.  She also reported that the comment period for the proposed San Miguel Ranch is now closed.  On July 6th, hearings for the San Miguel Ranch and Paso Robles Ground Water Basin Study will be heard by the County Planning Commission.

1.   Gravel Mines & Viborg Reprocessing (Tentative) Update – Jeff Oliveira from County Planning and Building, Environmental & Recourse Management Division

Pehl Mine: Hearing with Planning Commission was January 22, 2009.  Applicant requested a continuance but was denied due to applicants refusal to re-design project. Sue Harvey from the audience asked if Mr. Pehl will appeal to the Board of Supervisors.

Mr. Oliveira answered, yes, and stated that the Planning Staff will continue to recommend an EIR. Gary Davis asked if reports used for a project could become dated.  Mr. Oliveira stated that there was a five year sunset on certain reports like traffic, ect.

Denis Degher asked about the Area Specific Plan which suggests that before a project such as a sand mine gets approved the evolution, development, and response of the Salinas River should be studied.  Mr. Oliveira responded that funding for this study is difficult but costs could be shared with applicants.

Gary Davis asked is changes in a project equate to a “new project?”  Mr. Oliveira replied that it depends on the type of changes, fees, and staff time.

Viborg Sand and Gravel Mine: The County of San Luis Obispo has been served with a law suit pertaining to this project.

Pankey Sand Mine:  The proposed Pankey Sand and Gravel Mine is on continuance off calendar.  Technical issues such as the following are being

worked on:  sediment budget, cumulative impacts, response to river if project goes through, Fish and Game looking into geomorphology issues, EIR still recommended from Planning Commission Staff-plan to go to BOS in April to recommend EIR, no agreement with Pankey for EIR, applicant will require permits from Regional Water Quality Control and Fish and Game to approve project. Sue Harvey from the audience commented that permits from Fish and Game and documents from CEQA (California Environmental Quality Act) would be required for the approval of the project.  She asked what it would take to get Fish and Game to permit the project in view of their earlier statements concerning extraction amounts.  Mr. Oliveira replied that the Fish and Game would have to take back their statements pertaining to extraction amounts.

Martin and Wyrick Sand Mines; Both are in holding pattern-EIR being considered.

Denis Degher asked if they were pulling out any sand right now.  Mr. Oliveira wasn’t sure.  He stated that they wanted to dredge the pond.  What makes a mine is that you are selling the sand.

Viborg Concrete and Asphalt Recycling (North River Road): A Conditional Use Permit wasapproved by the Planning Commission and is being

appealed to the BOS on April 28, 2009. This is a vested mine, at 4000 North River Road, that stopped mining back in 1995 and started recycling.  The County was monitoring the mine, and once recycling became the primary use, new permits were required.

Denis Degher stated that the Viborg Recycling Operation is now within the San Miguel Vicinity.

2.    San Miguel LLC Co – Sub 2007 – 00216; Subdivision & Conditional Use Permit; Mission Street – 20 Parcels

Lot sizes have been downsized from 71,000 SqFt to 67,000 SqFt so less parking is needed.

All units usable for commercial and residential uses.

Community Plaza to be built first with other spaces sold ten years out.

Denis Degher stated that he didn’t think we should slack off  about our desires to build green.  He further stated that Shandon is working on their “green” design plan also.

Elizabeth Kavanaugh stated that the San Miguel Design Plan dictates material and style, pre 1950.

Lynne Schmitz stated that the original design plan was a town effort and that she doesn’t want to see a “cookie cutter” look.

Linda Mora recommended that we shoot for an “eclectic” look and that we let the people “use the process.”  She stated that she felt Brent Butterfield would do a good job.

Patty Davis responded to Linda Mora’s comment about Brent Butterfield doing a good job by commenting on the fact that Mr. Butterfield would not be the builder on all the units.

Dale Hamblin stated that we cannot tell people to build green unless required by law and that developers should not have to go to the council for individual approval.

Statements from Denis Degher, Mike Sanders, Gary Davis, and Debbie Lewis supported individual builders being required to get individual approval from the council prior to building.

Elizabeth Kavanaugh from County Building and Planning stated that individual approval for each building could delay building up to nine months. Debbie Lewis stated that she would rather see a project delayed for nine months than have to drive by an ugly building for twenty years.

Mike Sanders recommended that we try to show developers the benefits and kickbacks of “going green.”

Dale Hamblin recommended that the council not over reach too much.  The Design Plan was adopted by the BOS and any additions would have to be approved by the BOS. Some recommendations for environment might be able to be made to a certain degree, but it wouldn’t be a short process.

The council approved the following recommendations with a 7-0 vote.

a.  10% Efficiency Requirement

b.  Want to meet and talk with individual developers about “green options”

c.   Let developer get to know us

d.  Smaller square feet- OK

e.  Third story design features-OK

f.  Reciprocal Parking

3.  Proposed Cell Tower Site – DRC – 2008-00063 PG&E Metro PCS, North Co, E-Ref, C MUP -North River Road

According to Tricia Night, PG&E has purchased frequencies which allows them to use other towers.  PG&E wishes to add some additional antennas to the already existing tower on North River Road.  The tower height will remain at 91ft.  Denis Degher motioned to approve the project; the vote was 7-0 in approval.

New Business and Referrals:

1.  DRC2008-00089 TAYLOR, North Co. E-Ref, MUP Moved to March Agenda.

2.  Christian Lazo Winery – DRC2008-00074 – MUP 600SqFt Winery; Off Drake Rd. NW Paso Robles Christian Lazo Winery would like to operate a micro winery in a 600SqFt existing building with a concrete pad outside.  Denis Degher motioned to approve the project; the vote was 7 -0 in favor of the project.

3.  SMAC “Meritorious Citizens Award”

Denis Degher motioned to create a Meritorious Citizens Award.  The vote was 7-0 in favor of the award.
